Terms of Use
The website www.agenziaferrari.net (the “Website”) is managed by Ferrari Chiavari s.a.s. di Ferrari Paolo & C., with registered office at Via della Libertà 32, Rapallo (Genoa). The Administrator is an Italian company with registered and operating office in Rapallo (Genoa), VAT No. 03107630109. The terms and conditions set out below apply to the content of the entire Website and, together with any page or document to which such terms and conditions may refer, constitute the terms and conditions under which the Administrator allows use of the Website. Access to the Website’s content is subject to careful reading and acceptance of these Terms and Conditions of Use (the “Terms”). Use of the Website implies full acceptance of the Terms.
By logging in or using the services available on the Site, the User accepts these Terms of Use. If the User does not accept them, they must refrain from using the Site. Ferrari Chiavari s.a.s. invites Site Users to periodically review these Terms of Use and the other sections of the Site, such as the Personal Data Processing Notice (Privacy Policy) and the Cookies Notice (cookie policy), also in order to check for any updates or changes.
1. INTRODUCTION.
Industrial and intellectual property.
Ferrari Chiavari s.a.s. is the sole owner of the contents of the Site, including, by way of example and not limited to, texts, documents, images, logos, photographs, page layout, design, know-how; some of the aforesaid contents may be protected by copyright, trademarks, patents, models and/or other industrial and intellectual property rights recognized by Italian and international law. No content of the Site may be deemed or construed as licensed by Ferrari Chiavari s.a.s. or as the subject of any other right of use by users and/or third parties.
Many sections of this Site are accessible even without registration. Other sections, however, require registration by providing certain personal data identifying the user. For the processing of such data, the Administrator complies with the Privacy Policy.
The Administrator reserves the right to change the Conditions set out below at any time, simply by updating this legal notice page. Therefore, users are invited to periodically check the most up-to-date version of these Conditions. It is also noted that some of the terms or conditions specified below may be waived and overridden by specific provisions set out in other sections of the Site.
2. License terms
Unless otherwise stated in these Terms or in other sections of the Site, all copyrights and any other intellectual or industrial property rights, or any other rights of any nature in any of the content or aspects of the Site, belong to the Administrator or are licensed to the Administrator by the respective owners. Such works are protected by local laws and international treaties on industrial property and copyright, and all related rights are expressly reserved. Any use of the Site’s content not expressly permitted by these Terms is prohibited. In the event of a breach of any of the Terms, the Administrator reserves the right to deny access to the Site and to request the immediate return or destruction of any material printed or downloaded from the Site.
The User is allowed to print or download certain extracts from the Site solely for strictly personal use, provided that:
• no document or graphic element of the Site is modified in any way;
• no graphic element of the Site is used separately from the related text;
• any copy, paper or digital, of the materials downloaded or printed from the Site is modified in any way, and the separate use of images, photos, videos, audio, graphics or other items from their related Credits is not permitted.
The position of the Administrator, or of the person(s) appointed by them, must always be stated as the author of the material published on the Site.
Except as stated above, no part of the Site may be reproduced or stored on any other website or included in any information storage and retrieval system or service delivery system, without the Administrator's prior consent.
Any other right or authorization not expressly mentioned in these terms is expressly reserved.
3. Site access
The Administrator will do its best, in line with a commercially reasonable standard, to ensure that the Site is always accessible. However, the Administrator shall not be liable if, for any reason, the Site may be unavailable even for limited periods of time.
Access to the Site may be temporarily suspended, even without notice, in the event of system errors, support or maintenance needs, or for any other reason beyond the Administrator's reasonable control.
The user is solely responsible for activating and maintaining all agreements and services that allow access to the Site.
Without Lionard’s prior written consent, any unauthorized access to the Website’s restricted areas is expressly prohibited, as it constitutes a violation of Lionard’s intellectual property rights.
If the User receives an identification code, password or any other information as part of the security procedures of Ferrari Chiavari s.a.s., they must treat such information as confidential and not disclose it to third parties.
Ferrari Chiavari s.a.s. reserves the right to disable at any time the identification code and/or password, chosen by the User or assigned by Ferrari Chiavari s.a.s., if, in its opinion, the User has not complied, even only partially, with these Terms.
If the User knows or suspects that another person is aware of their identification code or password, they must immediately inform Ferrari Chiavari s.a.s. by sending an email to info@ferrarihotels.eu.
4. User Conduct.
Except for personal data that will be processed in accordance with what has just been specified, any material, content, etc. transmitted or posted on the Site will be considered non-confidential and non-proprietary. Therefore, the Administrator assumes no obligation with regard to such information and materials and will be deemed authorized to copy, transmit, disclose and use such materials, whether for commercial purposes or for other purposes.
The User agrees not to post or transmit to or from the Site any material:
• that is intimidating, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, likely to incite racial hatred, discriminatory, threatening, scandalous, inflammatory, blasphemous, in breach of confidentiality obligations, infringing privacy, or that may in any way cause annoyance or harm; or
• for which the necessary licenses or approvals have not been obtained; or
• that depicts and/or encourages conduct that could be considered criminal, that may give rise to anyone’s liability, that is in any way contrary to law, public order or morality, or that infringes third-party rights anywhere in the world; or
• that cause damage (including, by way of example and without limitation, computer viruses, logic bombs, Trojan horses, worms, defective components, corrupted data or other software with harmful content or capable of causing damage).
The User may not misuse the Site (including, by way of example and without limitation, by carrying out hacking activities).
The Administrator will actively cooperate with the public authorities in charge of carrying out investigations and will comply with any court order requiring or ordering the Administrator to disclose the identity of, or identify, the persons who transmit or post material that is not compliant with the law and/or with the provisions set out above.
5. Site registration
Each registration on the Site is valid for one user only. Any ID code, password, username or other, is an integral part of the security systems and procedures activated by the Administrator to protect the system and the data stored on the Site. Therefore, they may not be disclosed to anyone, not even within a group, even if identified. The Administrator reserves the right to disable the ID code, password and/or the relevant user-name of any Site user whenever, in the Administrator's sole discretion, there has been any breach of any of these Conditions.
Responsibility for password confidentiality and use lies solely with the user, who assumes all related risks.
The registered user's personal data will be processed in accordance with the notice set out in the Privacy Policy published on the website, available at the relevant link.
6. Links to other sites
Links to third-party websites on the Site are provided solely to facilitate access to content. By using them, you leave the Site. The Administrator does not control and is not responsible for how such sites are managed, their content, or their availability for use. The Administrator therefore makes no warranties or representations regarding them, or any material that may be found there, or any results that may be obtained from their use. If the User decides to access them by following the links provided on the Site, they do so under their sole responsibility and at their own risk.
If the user wishes to create their own link to the Site, they may do so only provided that an actual link to the Site’s homepage is created, and that the Site’s content is not reproduced, and provided that:
• are not removed, distorted or otherwise altered in size or in any way the features of the Lionard brand and its logo;
• no frame is created and/or no other browser or setting is placed around the Site;
• such link does not imply, even indirectly, that the Administrator is promoting third-party products or services;
• this does not attempt to represent, even indirectly, any form of relationship between the Administrator and the user, nor does it attempt to convey false, biased or distorted information about the Administrator;

• that such link is not implemented by a site not managed by the user;
• the user's website does not contain disgusting, offensive or controversial content, infringing any intellectual property right or any other third-party right, or otherwise violating laws, regulations, public order or public decency.
The Administrator reserves the right at any time to revoke the user’s right to create a link to the Site or to take any other action deemed necessary or appropriate if even just one of the terms specified in this section is violated.
The User shall hold the Administrator harmless from any loss or damage suffered by the Administrator due to a breach of any of the conditions set out in this section.
7. Important information
The Administrator will ensure that the information published on the Site is always accurate and up to date; however, no warranty is given in any way as to the completeness of the information on the Site. The Administrator may at any time modify the Site and its contents, or change the description of products and/or services and, where applicable, their prices, and may do so without any prior notice. The Site is provided solely for home and/or private use and its use is free of charge.
9. Terms for using the site
The User assumes all costs and responsibility for any upgrade of their hardware, software or other equipment, or for any repair, maintenance or correction thereof, as may be necessary to access the content or use the services provided by this Site.
10. Governing law These General Terms and Conditions, as well as any relationship between the Administrator and the User, are governed by the applicable national and international laws in force in Italy. To the extent legally permitted, for any legal matter arising from the existence, content and/or interpretation of these Terms and Conditions or from any relationship between the Administrator and the User, the competent court shall be that of the city of Genoa.

All content on this website, including but not limited to images, illustrations, audio clips and video clips, is protected by copyright; the “Ferrari Hotels Real Estate” trademark and other service marks and/or other intellectual property rights are owned by Ferrari Chiavari s.a.s. or its affiliates, or by third-party content providers, merchants, sponsors and licensors (collectively “Providers”), who have licensed their content or the right to market their products and/or services to Ferrari Chiavari s.a.s..
All intellectual property rights are governed by Italian law, international laws and international and EU treaties on copyright, privacy and advertising laws, and communication regulations and statutes.
Any modification and use of the Content on any other website or network environment is expressly prohibited, as is the use of the Content for purposes other than personal use.
