PRIVACY POLICY
This Privacy Policy ("Policy") is intended to describe the methods and purposes of the processing of personal data carried out by Ferrari Chiavari s.a.s. di Ferrari Paolo & C., with registered office at Via della Libertà 32, Rapallo (Genoa), as data controller (hereinafter, “Agenzia Ferrari” or the “Controller”) of the website www.ferrarihotelsre.com (the “Site”) and the related services (the "Services").
Ferrari Agency respects the privacy of every user who visits the Site and uses the Services ("User"). This Policy does not apply to third-party sites accessible via external hyperlinks on the Ferrari Hotels Site.
The processing of Users’ personal data will be carried out in accordance with applicable law, with particular reference to Legislative Decree of 30 June 2003, no. 196, containing the Personal Data Protection Code, as amended by Regulation (EU) no. 679 of 27 April 2016 - applicable from 25 May 2018 (hereinafter, jointly, the “Applicable Privacy Legislation”).
This notice is provided only for the above-mentioned sites and not for any other websites that the user may consult via specific links. Users/visitors must carefully read this Privacy Policy before sending any type of personal information and/or completing any electronic form on the site.
This Policy and the methods of use and management of Cookies may be subject to changes or updates at any time. In such event, Agenzia Ferrari s.a.s. will publish a notice on the website homepage. In any case, Agenzia Ferrari s.a.s. invites you to periodically check the Privacy Policy to be informed of any changes.
The data protection officer is Mr. Paolo Ferrari.
TYPES OF DATA PROCESSED AND PURPOSES OF PROCESSING
1) Browsing data
The IT systems and software procedures used to operate this website collect, during normal operation, certain personal data that are then implicitly transmitted through the use of Internet communication protocols. This is information that is not collected to be associated with identified data subjects, but which by its very nature could, through processing and matching with data held by third parties, allow users to be identified. This category of data includes:
- identification and contact details (e.g., first name, last name, email, phone number, etc.);
- data relating to the content of electronic communications exchanged with Agenzia Ferrari for the purposes set out in paragraph 2 a);
- data relating to an User’s IP address or device ID through which access to the Site is made or the Services are used;
- data relating to the type of browser used by Users, as well as the date and time of use to access the Site or the Services.
2) Data retention periods and purpose of retention
The data referred to in the previous paragraph are used solely to obtain anonymous statistical information on the use of the site and to check its proper functioning, as well as for the following purposes:
- respond to Users’ requests submitted via the Site;
- improve the layout, features and functionality of the Site and the Services, as well as the administration and management of Users’ requests;
- allow Users to take part in surveys and polls anonymously;
- provide support on the services offered, at Users’ request;
- prevent fraud or crimes committed through the Site or the Services;
- comply with legal or tax obligations under applicable law;
- with prior consent, contact Users via automated tools (email, SMS, MMS, social media, calls without an operator) and non-automated tools (postal mail and phone calls with an operator) to offer them commercial offers and promotions, as well as involve them in market research and surveys, including by sending periodic newsletters;
- with prior consent, analyse Users’ choices and commercial preferences when using the Site or the Services, in order to personalise the offer of products and services dedicated to them.
For the purposes set out in points A) to F), Agenzia Ferrari will process Users’ personal data on the basis of the requests submitted by them and its legitimate interest. For the purposes set out in points g) and h), Agenzia Ferrari will process Users’ personal data on the basis of their consent. Personal data processed by Agenzia Ferrari on the basis of the User’s consent will be kept for the time strictly necessary to achieve the purposes for which they were originally collected and, in any case, will no longer be processed following any withdrawal of the consent given. Where the processing of personal data instead takes place in compliance with legal, tax or judicial obligations, or for the establishment of liability in the event of alleged cybercrimes against the website, the data may be retained for up to a maximum of ten (10) years. Data voluntarily provided by users/visitors
If users/visitors, by accessing this website, send their personal data to use certain services, or to submit requests via chat and/or email, this will result in Agenzia Ferrari s.a.s. acquiring the sender’s address and/or any other personal data, which will be processed solely to reply to the request or to provide the service. The personal data provided by users/visitors will be disclosed to third parties only if such disclosure is necessary to fulfil the requests of the users/visitors themselves.
"Contact" form
The data provided through this form are your first and last name, your email address and phone number, and will be used solely to reply to your requests or questions. Providing this data is mandatory to submit a request to Agenzia Ferrari, and any refusal to provide it will prevent you from receiving a reply.
5) Processing methods
Personal data are processed using automated tools for the time strictly necessary to achieve the purposes for which they were collected. Specific security measures are observed to prevent data loss, unlawful or incorrect use and unauthorized access. All personal data will be processed mainly through electronic tools and methods; however, processing by paper means is not excluded a priori by Lionard. The Data Controller will adopt all necessary security measures in order to minimize the risks of destruction or loss, including accidental loss, of the data, unauthorized access, or processing that is not permitted or not in line with the purposes indicated in this document. However, since it is not possible to guarantee that the measures adopted for the security of the Site and data transmission are such as to exclude any risk of unauthorized access or data dispersion, we invite the user to ensure that their computer is equipped with up-to-date antivirus software for online data protection—both incoming and outgoing—and that their Internet service provider has adopted firewalls and anti-spam filters, or other suitable measures for the security of data transmission.
6) Optional provision of data
Apart from what is specified for browsing data, users/visitors are free to provide their personal data. Failure to provide them may only result in the inability to obtain what is requested.
7) Passively collected information
In providing our services we will use third-party software and/or services to passively collect information, without your knowledge, while you browse or interact with the content of our website, as well as information about the device you use. The sole purpose of passively collecting this information is to better understand how you use and interact with the Web, with the aim of improving your experience in using our services and identifying possible errors during the development of our site. The information collected includes, by way of example and not limited to:
- Your device’s IP address
- The screen size of the device used
- Device (unique identifier) and browser information
- Geographic location (country)
- Selected language used to view the website
- Pages visited
- Date and time the pages were visited
For this purpose, we use a third-party web analytics service, which passively collects information in order to review website usage and, in general, to gather information about website activity. Please also note that Agenzia Ferrari may use third-party services such as Google Analytics, which collects information about your browsing through cookies or other mechanisms. In no case does Agenzia Ferrari collect or store identifying data (including, in particular, banking details or payment procedures).8) Transfer of personal data abroad
Users' personal data will not be transferred to non-EU countries that do not ensure data protection levels in line with the applicable Privacy Regulations.
9) Processing of minors’ personal data
Use of the Site and Services is reserved only for adult Users. Agenzia Ferrari does not process personal data of minors under eighteen (18) years of age without parental consent.
10) Place of data processing
The processing related to the web services of the above-mentioned sites takes place at the registered office of Agenzia Ferrari in Rapallo (Genoa) and/or at the premises of the company providing hosting and/or website management, and is handled only by technical staff of the Office in charge of processing, or by any staff appointed for occasional maintenance operations. No data deriving from the web service is communicated or disclosed. The personal data provided by users who submit requests to receive information material is used solely to perform the requested service or provision and is communicated to third parties only where this is necessary for that purpose.
11) Data Controller
The data controller, as defined by Art. 29 of the Privacy Code, is Ferrari Chiavari s.a.s. di Ferrari Paolo & C. (info@ferrarihotels.eu).
12) Data subject rights
Under the Applicable Privacy Regulations, Users will have the right to:
- be informed about the purposes and methods of processing their personal data;
- access their personal data;
- obtain a copy of their personal data, where such data are stored in countries outside the European Union, as well as obtain information on the place where such personal data are stored or transferred;
- request the correction, updating or completion of their personal data;
- request the deletion, anonymization or blocking of the processing of their personal data;
- object, in whole or in part, to any processing carried out through automated decision-making processes, including profiling;
- withdraw their consent to processing, where given, freely and at any time;
- contact the Data Protection Officer of the Controller;
- lodge a complaint with the Data Protection Authority.
Pursuant to the Applicable Privacy Regulations, starting from May 2018 Users will also have the right to exercise the following rights:
- the right to Data portability, i.e. the right to receive your personal data in a structured, commonly used and machine-readable format, and the possibility to transmit them to another data controller freely and without hindrance;
- the right to request the restriction of the processing of your personal data.
Requests for updating, correction, deletion or otherwise relating to the processing and retention of data must be sent to the Data Controller at our registered office in Rapallo (Genoa), via della Libertà 32, or by email to info@ferrarihotels.eu stating as the subject: "Deletion of personal data".
The letter must include:
- Applicant’s first and last name
- Written request for deletion/update/correction
- Email address used for registration (e-mail)
- Password to access your personal area (if available)
- Copy of ID card or passport
- Contact address and phone number
